 3.1 Customer support and data maintenance 
ALPINA Burkard Bovensiepen GmbH + Co KG (hereinafter referred to as ALPINA) tries to make it as easy as possible for customers to contact us in order to be able to respond to any concerns as quickly as possible. For this reason, it is possible to contact ALPINA at various points. These include the ALPINA contact form on the Website (see 3.2), the ALPINA landing pages (see 3.3), the ALPINA Car Configurator and the ALPINA Vehicle Exchange (see 3.4). Irrespective of the contact options already mentioned, the Customer may give ALPINA its consent to customer support (see Section 5).

All requests of this kind are queried by means of a double opt-in procedure. Any requests can only be processed once an e-mail automatically generated by ALPINA has been confirmed by the recipient of the request. It is therefore necessary for the recipient to provide a correct e-mail address in order to confirm his/her identity. If the e-mail is not confirmed, no data will be stored or processed. The process relating to the request will be aborted and deleted.

It is also possible to contact us via the ALPINA online store (see 3.5) and via ALPINA's corporate presence on various social platforms (see 3.6). It is not possible at this point to give consent to customer support that goes beyond the request made, so that only the respective request can be processed.

3.2 ALPINA contact form 
Customer concerns can be sent  directly to a specialist department of ALPINA Burkard Bovensiepen GmbH + Co KG 
via the website contact form. This process requires the customer's name, a valid e-mail address, a categorization of the request and a description of the request. The request will only be forwarded if the confirmation e-mail sent in response is confirmed by the customer (so-called double opt-in procedure, see point 3.1).

If the customer wishes to receive customer support that goes beyond the request, the customer can give their consent to customer support (see no. 5). The declaration of consent is not necessary to process the request.

3.3 ALPINA Landingpages 
During a new release of a BMW ALPINA model, a special microsite is offered on the ALPINA website (so-called ALPINA Landingpages), which enables the customer to contact ALPINA directly regarding the model. In addition to a detailed product description and presentation, a contact form is offered on the ALPINA landing page. The customer can use this to request information about the product by post. The name, address and an e-mail address are required to process the request. In addition, the confirmation email must be confirmed (so-called double opt-in procedure, see point 3.1). If this is not confirmed, no data will be saved and the process cannot be carried out.

In addition, a voluntary declaration of consent can be submitted if the customer wishes to receive customer support that goes beyond the request (see point 5). Consent is not required in order to process the request.
 Furthermore, the data may be viewed by the responsible service providers for the technical implementation and support of the microsites (see point 6).

At irregular intervals, it will be possible for customers and interested parties to apply for a test drive via an ALPINA landing page. As the test drives are only offered to customers/interested parties aged 25 and over, it is necessary to state their age. In addition, the first/last name, e-mail address and a valid telephone number are required in advance for the organization of the test drives. To ensure the authenticity of the data, confirmation of a confirmation email is required (so-called double opt-in procedure, see point 3.1). All other information is not mandatory for the implementation, but serves to improve product advice and can therefore be provided voluntarily. An ALPINA employee will then contact the customer/prospective customer by telephone as part of the organization and refer him/her to an ALPINA sales partner (see point 6) to carry out the test drive.

3.4 ALPINA Car Configurator and ALPINA Vehicle Exchange 
Via the ALPINA Car Configurator it is possible to request offers for new ALPINA vehicles. Via the ALPINA Car Exchange it is possible to request an offer for an ALPINA stock vehicle from ALPINA or a dealer. A request via the ALPINA Car Configurator or the ALPINA Vehicle Exchange is sent 
directly to the respective ALPINA sales partner of the BMW dealer organization and a copy of the request is sent to ALPINA Burkard Bovensiepen GmbH + Co KG. These processes require the customer's name, a valid e-mail address and the customer's address. The request will only be forwarded if the confirmation email sent in response is confirmed by the customer (so-called double opt-in procedure, see point 3.1). If this is not confirmed, no data will be stored by ALPINA.

If the customer wishes to receive customer support that goes beyond the request, the customer can give their consent to customer support (see point 5). The declaration of consent is not necessary to process the request. If the customer's consent is granted, it will be forwarded both to ALPINA Burkard Bovensiepen GmbH + Co KG and to the respective trade organization.

3.5 ALPINA CLASSIC Shop 
ALPINA sells its own lifestyle and accessory articles as well as high-quality accessories and spare parts via the ALPINA CLASSIC Shop. The online store is based on the Magento II eCommerce system and is managed, in addition to ALPINA, by the service providers listed under point 6.

Items can be selected and an order initiated in the online store. The order is sent directly to the relevant department and processed there. The name, e-mail address, billing address and delivery address are required to place an order. This data is collected in order to carry out the ordering process. In addition, a customer account can be created in the ALPINA online store. The customer can thus save, view and, if necessary, change the data provided.

The data is stored in the ALPINA customer database and in the online store system. Consent for any further customer support cannot be given at this point. All data is only stored within the ALPINA online store. Information on the storage period, information and deletion can be found under points 8 and 9. However, a customer account is not necessary to carry out an order process. In the case of an individual order, the customer data will only be stored in the ALPINA customer database in accordance with the legal requirements and will not be used for any further customer measures.

3.6 Contact via social networks 
Contact with ALPINA Burkard Bovensiepen GmbH + Co KG can be made via social platforms. Inquiries via social networks are only processed directly; no data is stored. All statistics from social networks are processed and evaluated anonymously. The data protection regulations of these platforms can be found on the respective platform. 3.7 Processing of personal data for the purposes of your application

To enable you to submit a speculative or targeted application for one of our advertised vacancies, please send your application documents to the e-mail address provided for this purpose on our website. For the purposes of receiving and processing your application, we will process your personal data depending on the scope of the personal data you submit. Legal basis for the processing of your personal data: Decision or establishment of an employment relationship in accordance with Section 26 of the Federal Data Protection Act. You are welcome to send us your application documents in an access-protected file; please contact us in this regard and provide us with the information required to access your application documents.

4. Automatically collected data

4.1 Cookies 
Cookies are small text files that a web browser receives when visiting a website and stores locally on the PC, provided that the web browser used is enabled for this. Cookies are not necessary for the smooth use of all ALPINA online presences. The user is free to deactivate cookies (see section 4.1.1 - .4.1.5). Our service providers use cookies to improve the quality of the structure and content of the ALPINA website. ALPINA does not use cookies for sales or marketing purposes. Furthermore, cookies are not assigned to personal data.

So-called session cookies are used for the duration of a user's visit to ALPINA's online services. They are used, for example, to record which products have been viewed in the ALPINA online store or placed in the shopping cart. When you leave our website, these cookies are deleted again. Longer-term cookies are used in order to be able to offer product offers, for example, in line with the user's interests on subsequent visits and to improve the quality of our website. The cookies used can be managed at any time in the web browser settings (see points 4.1.1 - 4.1.5).

As a rule, cookies cannot damage the PC's software. They do not pose a security threat in the sense of viruses or the spying out of personal data. Nevertheless, we recommend that you always use the Internet with up-to-date virus protection and an up-to-date and intact firewall. Please use the help function of your browser to allow, reject, view and delete cookies. 4.2 Google Analytics 
Google Analytics is a web analysis service of Google LLC ("Google") for a statistical evaluation of the use of websites. The information is evaluated by ALPINA with date and time information for internal statistical purposes with regard to advertising measures, website use and website optimization. All analyzed information is limited to the ALPINA websites and their use. In addition to ALPINA, service providers have access to the results (see point 6). The user's behavior is evaluated anonymously. It is not possible for ALPINA and its service providers to trace back to personal data. Pseudonymous user profiles are not created. Google Analytics uses a so-called tracking code, which is integrated into the HTML code of the individual pages of our websites. The information generated by the tracking code about your use of the websites is usually transmitted to a Google server in the USA and stored there. However, if IP anonymization is activated on this website, your IP address will first be truncated by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide ALPINA with other services relating to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. In addition or as an alternative to the browser add-on, you can prevent tracking by Google Analytics on our pages by clicking on this link. This will install an opt-out cookie on your device. This will prevent the collection by Google Analytics for this website and for this browser in the future as long as the cookie remains installed in your browser.

4.3 Google Maps 
We integrate the maps of the 'Google Maps' service - a map service that visually displays geographical information. Google Maps is a service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Maps collects, processes or uses personal data according to its own specifications, which is why ALPINA assumes no responsibility for the collection, processing or use of data by Google Maps. Please refer to the terms of use of Google Maps (Google) at http://www.google.com/intl/de_de/help/terms_maps.html and the privacy policy of Google Maps (Google) at http://www.google.com/policies/privacy/. ALPINA does not receive any data from Google Maps or any data that may be generated through the use of Google Maps.

4.4 Matomo 
This website uses the open source software Matomo for the statistical analysis of visitor access. The data collected by Matomo is not transferred to other servers or passed on to third parties, but is used in anonymized form to improve our offer. If your browser supports "Do-Not-Track" technology and you have activated it, your visit will be automatically ignored. By using this website, you consent to the processing of data about you by Matomo in the manner and for the purposes set out above.

5. Purposes and legal bases of processing 
5.1 Customer care (e.g. information about products and services, sending catalogs, sending newsletters by e-mail, offers, invitations to events).
 Here we rely on your voluntarily given declaration of consent with regard to the personal data provided by you, which was collected under point 3 (legal basis: Art. 6 para. 1 lit. a EU GDPR).

5.2 ALPINA Car Configurator and ALPINA Vehicle Exchange 
Performance of a contract or implementation of pre-contractual measures with the customer (legal basis: Article 6(1)(b) EU GDPR).

5.3 Organization of test drives (ALPINA landing page) 
Implementation of pre-contractual measures with the customer (legal basis: Article 6 para. 1 lit. b EU GDPR).

6. Categories of recipients

We only transfer your personal data to other recipients or only grant other recipients access to your personal data if this is necessary for the respective purposes of processing this personal data, if we have entrusted other recipients with the fulfillment of individual tasks or services and access to this personal data is necessary or cannot be ruled out as a result, or to processors within the meaning of Article 28 EU GDPR. The categories of recipients of personal data are

- Internal departments involved in the execution of the respective business processes 
- ALPINA sales partners of the BMW dealer organization (see 5.2) 
- Service providers for maintenance and administration of our website 
- Service providers in the context of order processing (e.g. newsletter dispatch)

The transfer of your personal data processed via our website to the above-mentioned recipients is based on your consent in accordance with Article 6 (1) (b) of the European General Data Protection Regulation, if this is necessary for the performance of a contract or the implementation of pre-contractual measures with you in accordance with Article 6 (1) (a) of the European General Data Protection Regulation, on the basis of the legitimate interest of the controller in accordance with Article 6 (1) (f) of the European General Data Protection Regulation, on the basis of order processing in accordance with Article 28 (1) of the European General Data Protection Regulation or, if necessary, for the decision or establishment of an employment relationship in accordance with Section 26 of the Federal Data Protection Act.

In addition, your personal data processed via our website will be transmitted to state institutions or authorities if we are obliged to provide information within the scope of possible legal obligations to provide information or by official or court decision. Furthermore, your personal data processed via our website will be transmitted to state institutions or authorities if this is necessary for the prosecution of criminal offenses against us as the injured party and for the prosecution of disruptions or misuse of our online offers or telecommunications services and systems or for the assertion, exercise or defense of civil law claims. The data controller has integrated components from Novalnet AG on this website. Novalnet AG is a full payment service provider that handles payment processing, among other things. If the data subject selects a payment method during the ordering process in the online store, the data of the data subject is automatically transmitted to Novalnet AG. By selecting a payment option, the data subject consents to the transfer of personal data for the purpose of processing the payment.  The personal data transmitted to Novalnet is usually first name, last name, address, gender, e-mail address, IP address and, if applicable, date of birth, telephone number, cell phone number and other data required to process a payment. Personal data relating to the respective order is also required to process the purchase contract. In particular, there may be a mutual exchange of payment information, such as bank details, card number, expiry date and CVC code, data on goods and services, prices. The transmission of data is intended in particular for identity verification, payment administration and fraud prevention. The controller will 
transmit personal data to Novalnet AG  in particular if there is a legitimate interest in the transmission. The personal data exchanged between Novalnet AG and the controller may be transmitted by Novalnet AG to credit reference agencies. The purpose of this transmission is to check identity and creditworthiness. Novalnet AG also passes on personal data to service providers or subcontractors  if this is necessary to fulfill contractual obligations or if the data is to be processed. The data subject has the option of withdrawing consent to the handling of personal data from Novalnet AG at any time. A revocation does not affect personal data that must be processed, used or transmitted for (contractual) payment processing.

7. Data transfer to third countries (outside the EU / EEA)

ALPINA does not transfer data from the EU/EEA to third countries. If the interested party does not reside within the EU/EEA, we will contact the nearest regional ALPINA sales partner of the BMW dealer organization, who will then contact the interested party.

8. Criteria for the storage of personal data

If you do not respond to the sending of information about ALPINA products after 5 years, all personal data collected by means of a procedure mentioned under point 3 and for the purpose of the topic mentioned under point 5 will be deleted. If you no longer wish your data to be stored for the above-mentioned purposes, you can exercise your rights (see point 9 and point 10 - Deletion and revocation) at any time. However, deletion can only be implemented if there are no legal retention periods to the contrary and it is technically possible. Otherwise, personal data will be anonymized.

ALPINA stores personal data received in the context of job applications. After completion of the application process, this data is deleted. This applies to applications (digital or in paper form) which are intended for a specific job advertisement. Data that is part of unsolicited applications is stored for 6 months. If this data is to be stored beyond the specified period, written consent must be obtained from the applicant.

9. Rights of data subjects - your rights

We would like to point out that you can exercise your right to information, rectification or erasure, restriction of processing and the right to data portability at any time. To do this, please send us your request with your full name via the e-mail address datenschutz@alpina.de so that we can guarantee written confirmation and clear assignment. Contacting us by telephone is not sufficient for this purpose.

10. Note on the revocation of the declaration of consent

You can withdraw your consent at any time. To do so, please contact us (see point 9). The legality of the processing carried out on the basis of the consent until the revocation (sending information about ALPINA products) is not affected by this.

11. The existence of a right of appeal to a supervisory authority.

If you as a data subject believe that the processing of personal data concerning you violates the specific content and requirements of the EU General Data Protection Regulation (Regulation (EU) 2016/679), you have the right to lodge a complaint with the competent supervisory authority.

12. Profiling - automated decisions

No automated decision-making is used for sending information about ALPINA products.
